Prayagraj: Taking serious note of the repeated use of marriage certificates issued by Arya Samaj, the Allahabad High Court has observed that Arya Samaj is abusing its beliefs in conducting marriages without considering the genuineness of the documents.
Hearing a habeas corpus petition, the court observed that the Arya Samaj Samaj was issuing marriage certificates without proper solemnity of marriage, and observed that the marriage could not be proved on the basis of this certificate alone.
Observing, Justice Saurabh Shyam Shamsheri observed, “The court is flooded with marriage certificates issued by various Arya Samaj Samitis, which have been seriously questioned during various proceedings of this court as well as other High Courts. . The institution has misused its faith in conducting marriages without considering the genuineness of the documents.”
The habeas corpus petition was filed by one Bhola Singh, who produced a certificate issued by Arya Samaj Mandir, Ghaziabad, claiming that he was legally married to “petitioner No. 2”.
“Since the marriage has not been registered, it cannot be construed merely on the basis of the said certificate that both the parties have entered into the marriage,” the court said in its judgment dated August 31.
“In the present case, the corpus is a principal one and an FIR has been registered against petitioner No. 1 (husband) by the father of petitioner No. 2 (wife), and investigation is underway. Hence, there is no case of illegal detention,” the court said.
