Mumbai Court issues bailable warrant against Shiv Sena’s Sanjay Raut in defamation case filed by BJP leader’s wife

A court here on Monday issued a bailable warrant against Shiv Sena MP Sanjay Raut after he failed to appear in connection with a defamation complaint filed by former BJP MP Kirit Somaiya’s wife Medha Somaiya. The Sewri Metropolitan Magistrate’s court had last month issued a process (summons) against Raut, asking him to appear on July 4.

However, neither Raut nor his lawyer were present in the court on Monday, said Medha Somaiya’s lawyer Vivekananda Gupta. “Therefore, we made an application for issuance of warrant against him, which was allowed by the court,” Gupta said.

Later, around 12 noon, Raut’s lawyers appeared in the court and demanded a stay on the warrant issued against the leader. However, the court dismissed the petition and adjourned the matter till July 18. Earlier, while issuing summons, the magistrate had said that the documents and video clips produced on record prima facie show that the accused had made derogatory statements against the complainant (Medha). So that the public can see it on a large scale and people can read it in the newspapers.

The court had said that the complainant had also proved prima facie that the reputation of the complainant was hurt by the words spoken by accused Sanjay Raut. Medha Somaiya, in her complaint filed through advocates Gupta and Laxman Kanal, claimed that Raut’s allegations against her and her husband of being involved in a Rs 100 crore scam on construction and maintenance of some public toilets were baseless and completely defamatory allegations against Under the jurisdiction of Mira Bhayander Municipal Corporation.

He urged the court to initiate proceedings against him on charges of defamation, as defined under sections 499 and 500 of the Indian Penal Code.
